Heard Parvesh Kumar Pandey, learned counsel for the applicant and Sri Attrey Dutt Mishra, learned A.G.A. for the State.
This application under Section 482 Cr.P.C. has been filed with a prayer to expedite the S. T. No. 50 of 2017 (State Vs. Dhananjay Yadav), in Case Crime no. 49 of 2017, under Sections 363, 366 & 376 I.P.C. and 3(2) (v) S.C./S.T. Act, and 3/4 of P.O.C.S.O. Act, Police Station Soraon, District Allahabad (Prayagraj), pending before the court of Special Judge/P.O.C.S.O. Act, Allahabad (Prayagraj).
It has been argued by the learned counsel for the applicant that the applicant is the informant in this case, therefore, a direction is sought to be issued to the trial court for expeditious disposal of this case within certain stipulated time.
Learned A.G.A. has pointed out that an application under Section 319 Cr.P.C. has been allowed by which one accused has been summoned and three witnesses, statements of which have been recorded may be required to be re-summoned, which would take time.
Looking to the above situation, it is directed that court below shall make all endeavour to decide this case expeditiously preferably within a period of one year from today without permitting undue adjournments to either side, if there is no legal impediment.
With aforesaid direction, this Application under Section 482 Cr.P.C. is finally disposed of without issuing any notice to O.P. No. 2 as it is an innocuous order. If the O.P. No. 2 feels aggrieved, he may approach this Court.
