Heard learned counsel for the revisionist, learned AGA for the State and perused the record of this revision.
This revision has been filed for quashment of the impugned order dated 06.03.2019 passed by Sessions Judge, Ghaziabad in Misc. Case No.88 of 2019 and order dated 12.11.2018 passed by Additional Civil Judge (Senior Division), court no.7/A.C.J.M. in Complaint Case No.528 of 2018, under Section 138 of Negotiable Instrument Act, Police Station Modi Nagar, District Ghaziabad.
It has been submitted that the complaint of the applicant- revisionist under Section 138 of the Negotiable Instrument Act has been dismissed. Bare perusal of the order passed by the court below is indicative of fact that none other than the revisionist himself is to be blamed on account of his continuous absence in the proceedings. The order- sheet placed on record need no further explanation.
In view of above, both the impugned orders 06.03.2019 passed by Sessions Judge, Ghaziabad in Misc. Case No.88 of 2019 as well as order dated 12.11.2018 passed by Additional Civil Judge (Senior Division), court no.7/A.C.J.M. in Complaint Case No.528 of 2018, under Section 138 of Negotiable Instrument Act, Police Station Modi Nagar, District Ghaziabad are justified.
This revision lacks merit and the same is hereby dismissed.
