1. Heard Mr. Arun Kumr Mishra, learned counsel for the petitioner, Mr. H.K. Bhatt, learned Standing Counsel and Mr. Manish Pandey, learned counsel for the respondent No.1.
2. The petitioner filed writ petition No.24385(MS) of 2018 before this Court which was disposed of with direction to declare the petitioner's result of B.Ed. IInd Year Examination and process the documents of the petitioner for scholarship and reimbursement.
3. Pursuant to the notice issued in the present contempt petition, Sri H.K. Bhatt, learned Addl. Chief Standing Counsel has tendered an affidavit of Mr.R.C.Awasthi, District Social Welfare Officer, Ambedkar Nagar which is taken on record.
Along with the aforesaid affidavit of compliance, a copy of order dated 20.08.2019 has been appended.
4. From perusal of the aforesaid order, it is evident that the petitioner has been reimbursed scholarship/fee for an amount of Rs.36,360/- for the year 2016-17. In respect of 2015-16 when the petitioner was in B.Ed. 1st year, it has been said that the petitioner has wrongly mentioned the details of his B.A. IIIrd Year whereas he should have mentioned the details of M.A. 1st Year and, therefore, since his application for scholarship was incorrect, therefore, no scholarship has been provided for the year 2015.
5. In view of the decision dated 20.08.2019 taken in the case of the petitioner for providing/ reimbursing scholarship/fee nothing survives in this petition, which is hereby dismissed.
Contempt notice stands discharged. However, if the petitioner is aggrieved by the decision dated 20.08.2019, he may impugn the aforesaid decision in appropriate Forum/Court, if he is so advised and law permits.
