Supplementary affidavit filed today is taken on record. Heard learned counsel for the parties.
The petitioner is working as Peon in Bharat Singh Krishi Vidyalaya, Bharat Nagar, Tenua, Tehsil-Harraiya, District Basti. It appears that petitioner was suspended in January, 2018 and thereafter, petitioner's services was terminated by order dated 03.04.2018 which was disapproved by District Basic Education Officer, Basti, respondent no.3, by order dated 24.01.2019.
Pursuant to the disapproval order, petitioner has joined his duties on 31.01.2019, but he has not been paid salary for the period of December 2017 to January, 2019. In this regard petitioner has submitted representation to respondent no.3 on 30.08.2019, Annexure 8 to the writ petition, but respondent no.3 did not pay any heed to the representation of the petitioner.
Learned counsel for respondents submits that no useful purpose would be served in keeping the writ petition pending and an appropriate direction be issued to the respondent No. 3 to consider the grievance of the petitioner.
Considering the facts and circumstances of the case, without going into the merits of the case and with the consent of the parties, the writ petition is disposed of with liberty to the petitioner to file a fresh representation before respondent No. 3- District Basic Education Officer, Basti, raising all his grievances within a period of three week from today. In case any such representation is filed by the petitioner, respondent No.3, shall consider and decide the same by reasoned and speaking order within a period of two months thereafter.
With the aforesaid observations, the writ petition is disposed of.
