Heard Sri Paritosh Shukla, learned counsel for the applicants and the learned A.G.A., and Sri Dinesh Kumar Mishra, learned counsel for the opposite party No. 2.
This application under Section 482 Cr.P.C has been filed for quashing the proceedings of Case No. 2081 of 2016 (Smt. Neha Verma Vs. Manoj Kumar Verma and others), under Sections 498-A IPC, P.S. Gajraula, District Amroha, pending in the court of Additional Civil Judge (Junior Division)-II/Judicial Magistrate, Amroha.
This is a matrimonial dispute. Smt. Neha Verma, opposite party no. 2 has filed a short counter affidavit with assertion that matter has been amicably settled between the parties.
In this case, matter has been settled between the parties, therefore, no fruitful purpose would be served in keeping this matter pending any further.
In view of the law laid down by Hon'ble Apex Court in the case of Social Action Forum for Manav Adhikar and Another Vs. Union of India reported in 2018 SCC Online SC 1501, the entire proceedings ofCase No. 2081 of 2016 (Smt. Neha Verma Vs. Manoj Kumar Verma and others), under Sections 498-A IPC, P.S. Gajraula, District Amroha, pending in the court of Additional Civil Judge (Junior Division)-II/Judicial Magistrate, Amroha is hereby quashed.
