Sri Yogendra Kumar, learned Advocate, has filed memo of appearance on behalf of respondent no.1-Union of India today in Court, which is taken on record.
Heard Sri B.N.Pathak, learned counsel for the petitioner, Sri Vikas Budhwar, learned counsel appearing for respondent Petroleum Corporation, Sri Yogendra Kumar, learned counsel appearing for respondent no.1 and perused the record.
By means of this writ petition, under Article 226 of the Constitution of India, the petitioner has challenged the order dated 28.8.2019 passed by respondent no.3, whereby the candidature of the petitioner has been rejected on the ground that the land offered by the petitioner is not abetting the main road.
Learned counsel for the respondent Corporation submits that the petitioner has remedy to approach the competent authority as per Clause 18 of the Brochure.
In such above view of the matter, we are disposing of this writ petition with a direction that in case the petitioner moves an appropriate application before the competent authority of the respondent Corporation in compliance of the provisions contained under Clause 18 of the Brochure within a period of four weeks from today, the same shall be looked into by the competent authority and shall be disposed of within a further period of six weeks and of course before finalizing the allotment of dealership in respect of the location advertised.
With the aforesaid observations and directions, the writ petition stands disposed of.
