Learned counsel for the petitioner contends that the petitioner was appointed on leave vacancy on 16.1.1995. The person who was to join back after the completion of leave period, resigned and the petitioner had been allowed to continue till now.
Learned counsel appearing for respondent no.8, Sri Jain, points out that under Section 33(F) of U.P. Secondary Education Services Selection Board Act, 1982, Clause (1)(a), the leave vacancy can be converted into substantive vacancy, however, for a person who was appointed on or before May 14, 1991, but not later on August 6, 1993.
Learned counsel for the petitioner contends that although the case of the petitioner does not fall within the said period, however, there is no reasonable purpose in providing for the cut of period in provisions of Section 33(F)(1)(a) of the Act of 1982, referred to above.

Learned Chief Standing Counsel accepts notice for respondent nos.1 to 4.
Issue notice to respojndent nos.5 to 7, returnable in four weeks.
In the meantime, counter affidavit be filed.
