Heard Shri A. K. Rai, learned counsel for the petitioner, and Sri Nimai Dass, learned Standing Counsel for the respondent- State.
Learned Counsel for the petitioner states that the vehicle of the petitioner has been seized by the respondents and an amount of Rs.1,03,040/- towards road tax is being demanded from the petitioner. He further states that the petitioner is ready and willing to pay the amount in easy instalments.
Learned Counsel for the contesting respondent has no objection in accepting the amount in easy instalments.
Accordingly, this Court fixes four equal monthly instalments for the petitioner. The first instalment will become payable on 28th April, 2018 and the rest three instalments will be paid by the petitioner on the 28th day of each succeeding month.
Subject to deposit of half of the amount, the vehicle of the petitioner may be released.
In case, the petitioner deposits the amount in instalments as stated above, no collection charges shall be taken from him by the district authorities and no coercive measures regarding recovery may be taken against the petitioner.
Failure to deposit any instalment within time as stated above will leave it open to the respondents to proceed in accordance with law.
With the aforesaid observations, the writ petition stands disposed of. No costs.
