Heard learned counsel for the parties.
The instant writ petition is directed against the order dated 29 December 2017 passed by the second respondent, Director (Admn.) Medical Health Services, U.P., Lucknow, whereby, petitioner has been transferred from the office of Chief Medical Officer, Jaunpur to Ballia.
Learned counsel for the petitioner submits that petitioner would be satisfied in case the respondents are directed to consider and decide the representation dated 20.05.2017 within a time frame.
Learned Standing Counsel appearing for the State- respondents has no objection and would submit that the third respondent, Additional Director, Medical Health, Varanasi Region, Varanasi, is the competent authority to consider the grievance of the petitioner.
In regard thereto, the writ petition, on consent, is disposed of directing the third respondent, Additional Director, Medical Health, Varanasi Region, Varanasi, to consider and decide the representation of the petitioner, in accordance with law, by a reasoned and speaking order, expeditiously preferably within three weeks from the date of receipt of certified copy of this order along with the copy of the representation and annexures thereto.
It is clarified that this Court has not considered the claim and contention of the petitioner on merit.
