At the very outset, learned counsel for the applicant submits that the applicant is ready to make payment of dues outstanding towards opposite party no.2 in installments and further to stay the recovery proceedings directed in the order dated 15.5.2018.
In view of the above, it is directed that the applicant shall deposit Rs.10,000/- by 6th March, 2019 and the remaining amount shall be deposited in three equal monthly installments. The applicant shall continue to make payment every month together with the installments already directed hereinabove. In the event, the applicant makes payment of Rs.10,000/- by 6th March, 2019, the recovery proceeding instituted against the applicant under Section 125(B) of Cr.P.C. shall remain stayed.
However, it is made clear that in the event of default of any direction given hereinabove, the interim protection granted shall stand discharged and the court below shall be at liberty to proceed in accordance with law for recovery of the outstanding dues.
The application, accordingly, stands disposed of.
