Heard Shri Prince Srivastava, learned counsel for the petitioner and Shri B.P.Singh Kachhawa, learned Standing Counsel for the State.
Challenge has been raised to the citation of demand dated 30.01.2020, issued by the respondent no. 3 demanding Rs. 1,42,293/- towards the road tax.
At the outset, learned counsel for the petitioner states, the petitioner is willing to deposit the aforesaid amount, if some time is granted.
In view of the offer made by the petitioner, no useful purpose would be served in keeping the present petition pending or calling for a counter affidavit, at this stage.
Accordingly, the writ petition is disposed of with a direction that in case, the petitioner deposits an amount of Rs. 42,293/- on or before 31 October 2021 and the balance amount in two equal installments of Rs. 50,000/- each payable on or before 30 November 2021 and 31 December 2021 respectively, no coercive measure be adopted against the petitioner pursuant to the citation of demand dated 30.01.2020 issued by the respondent no. 3, subject to his compliance with the terms of this order.
In case of default of the conditions as mentioned above, the present order shall stand automatically vacated.
