Heard Mr Alok Tiwari, learned counsel for the petitioner and Mohd. Asif, learned counsel for respondent no.4.
The principal prayer made in the writ petition, reads thus:
"i. Issue a writ, order or direction in the nature of Certiorari to quash the impugned tender notice dated 10/13.02.2018 issued by the respondent no.4 (Annexure No.6 & 7 to the writ petition)."
The tender notice dated 10/13.02.2018, according to learned counsel for the petitioner, is the second tender notice. He submits that the first tender process commenced with tender notice dated 13.1.2018. In the first tender process, in which 6 tenderers participated, the petitioner was the second lowest participant. The respondent-authority, however, for some reason, had cancelled the said tender process and issued fresh tender notice dated 10/13.02.2018. The petitioner has not challenged the cancellation of the first tender process. Insofar as the second tender notice is concerned, we are informed by the respondent-authority that they have cancelled this tender process also on 19.02.2018. In view thereof, it is clear that the main prayer made in the writ petition stands satisfied. When we so expressed, counsel for the petitioner has not argued the petition further.
The writ petition is, accordingly, dismissed, as infructuous.
