Heard learned counsel for the applicant, learned A.G.A. and perused the record.
It is submitted by learned counsel for the applicant that in the present case one case has been shown in the gang chart against the applicant in which the applicant has been released on bail. The applicant is in Jail since 17-8-2009.
Keeping in view the nature of the offence, evidence, complicity of the accused ,severity of punishment and submissions of the learned counsel for the parties, I am of the view that the applicant has made out a case for bail Let the applicant Manoj Dhobi involved in Case crime no.670 of 2009 under section 2/3 of U.P. Gangster Act , Police Station Biwanr district Hamirpur be released on bail on his furnishing a personal bond and two sureties each in the like amount to the satisfaction of the Court concerned with the following conditions: ` (1)The applicant shall not tamper with the evidence. (2)The applicant shall report to the police station concerned in the first week of each month to show his good conduct and behavior. (3)The applicant shall cooperate in the early conclusion of the trial and will not seek any unnecessary adjournment. In default of any of the above mentioned conditions, the bail granted to the applicant shall be deemed cancelled and he shall be taken into custody forthwith.
