Heard learned counsel for the parties and perused the record.
This application under Section 482 of the Code of Criminal Procedure (for short 'Code') has been filed on behalf of the applicants with a prayer to quash the charge sheet dated 16.10.2017, summoning order dated 27.01.2018 as well as the entire proceedings of Case No. 4065 of 2018 (State v. Manoj Bhatiya), arising out of Case Crime No. 722 of 2017, under Sections 498A, 323, 504, 506 of the Indian Penal Code, 1860 and Section 3/4 of the Dowry Prohibition Act, 1961, Police Station - Kalyanpur, District - Kanpur Nagar, pending in the court of A.C.M.M.-II, Kanpur Nagar.
Learned counsel for the applicants contended that parties have settled their dispute amicably.
No compromise has been filed by the applicant Manoj Bhatiya and opposite party no. 2 Smt. Meenakshi Bhatiya. Only by asserting that the parties shall settle their dispute in future, proceedings cannot be quashed.
Resultantly, the instant application under Section 482 of the Code stands rejected.
However, if the applicant and Smt. Meenakshi file an application under Section 482 of the Code for quashing of the proceedings on the basis of compromise, the same shall be considered and decided by this Court.
