The petitioner has approached this Court with the following prayers:
“i) to issue a writ of Certiorari or any other appropriate writ, order or direction to quash Exhibit P1 and P2 Revenue Recovery Notices and all further recovery proceedings initiated by the 1st respondent, after calling for the record relating thereto.
ii) to declare that no amount as stated in Exhibit P1 and P2 notices is due from the petitioner
iii) to issue a writ of mandamus or any other appropriate writ order or direction commanding the 3rd respondent to declare that no amount is due from the petitioner as motor vehicle tax in respect of the vehicle bearing Registration No.KL.2C-552.
iv) Any other reliefs which may be prayed for from time to time, in the interest of justice.”
2. When the matter came up for consideration before this Court on 15.07.2014, the following interim order was passed:
“Admit. GP takes notice. There shall be an interim stay of Exts.P1 and P2 recovery notices for a period of one month.”
W.P(C)No.18094 OF 2014 2 Subsequently, on bringing up the factual position to the notice of this Court by the learned Government Pleader, the interim order was refused to be extended by order dated 14.08.2014, which reads as follows:
“There shall be no extension of stay, in view of the specific instruction received by the learned Government Pleader that, the tax due have been paid only upto 31.03.2009 as against the submission of the petitioner that, the tax amount is satisfied till 31.03.2011.
Post after a week for statement of the Government.”
3. Today, when the matter is taken up for consideration, there is no representation for the petitioner. It appears that the petitioner has lost interest in the cause of action projected in this writ petition. The writ petition is dismissed for non-prosecution.
