SHAH) Shri Akshay Vakil, learned advocate appearing on behalf of the petitioner has stated at the bar that as such the petitioner has already preferred an appeal before the appropriate authority against the Assessment Order dated 24/06/2012. Under the circumstances, he does not press the present petition qua the prayer in terms of paragraph 26(B). He has also stated at the bar, under instructions from the petitioner, that at this stage the petitioner also does not press the petition qua the prayer in terms of paragraph 26(D), however, has requested to consider the prayer of the petitioner in terms of paragraph 26(C). Hence, NOTICE returnable on 17/10/2013 qua the prayer in terms of paragraph 26(C) at this stage.
