The petitioner has approached the Geologist for issuance of 'P” Forms for removing the ordinary earth from the granite quarrying area covered by Ext.P1 permit. The petitioner is a holder of permit. It seems that the request for issuance of 'P' Forms has not been considered for the reason that the earth is required for filling the pit formed by the quarrying operations. This Court in Ext.P3 judgment held that it is not necessary that top soil should be used for filing the pit and that it is open for the Geologist to direct the petitioner to fill the pit in any manner if so warranted, to comply with the conditions in the permit. In view of the above, there shall be a direction to the Geologist to consider the petitioner's request for issuance of P Form for removing the top soil on the strength of Ext.P1 without insisting for Environmental Clearance and No Objection Certificate from the District Collector. Needful shall be done within a period of two weeks from the date of receipt of a copy of W.P.(C) No.29794/2014 2 this judgment.
The writ petition is disposed of with the above direction.
