Heard Sri D,S,Pandey, learned counsel for the applicant and learned A.G.A. for the State.
The instant application under section 482 Cr.P.C. has been filed with a prayer to quash the charge sheet dated 31.7.2018 in Case Crime No.142 of 2018, under sections 498-A, 323, 504, 506354, 403 IPC. P.S.Mahila Thana, District Ghaziabad as well as summoning order dated 1.1.2019 passed by Special Judge/Addl. Sessions Judge,Court No.9, Ghaziabad and also to stay the proceeding of Criminal Case No.2 of 2019.
Learned counsel for the applicant submits that the present report has been lodged on an application moved under section 156(3) Cr P.c. and it is a case of counter blast. The opposite party no.2 is the wife of co-accused Pradeep Chand and he is only a friend of the present applicant Neither he is family member nor belongs to the same caste.
Notice on behalf of opposite party no. 1 has been accepted by learned A.G.A.
Issue notice to opposite party no.2 returnable within four weeks at the address given in the application.
Opposite party no.2 may file counter affidavit within four weeks. Learned A.G.A. may also file counter affidavit within the same period. Rejoinder affidavit may thereafter be filed within two weeks.
List thereafter.
Till the next date of listing, further proceedings of the aforesaid case shall remain stayed.
