Heard learned counsel for the parties and perused the record.
This application under Section 482 of the Code of Criminal Procedure, 1973 (for short 'Code') has been filed on behalf of the applicant with a prayer to quash the impugned order dated 21.02.2019 passed by Additional Chief Judicial Magistrate, Nagina, Bijnor, in Complaint Case No. 4259 of 2018 (Manoj Agarwal v. Pramod Bajaj and others), under Sections 392, 506 of the Indian Penal Code, 1860, Police Station - Afzalgarh, District - Bijnor, whereby the application of the applicant to initiate proceedings against opposite party under Section 340 of the Code, was rejected.
As per provision of Section 341 of the Code, appeal shall lie against the impugned order passed by learned Magistrate.
Accordingly, the prayer for quashing the impugned order in the aforesaid case is refused.
