FOR R1) ...PETITIONER ...RESPONDENTS THIS WRIT PETITION IS FILED UNDER ARTICLE 226 OF THE CONSTITUTION OF INDIA PRAYING TO DIRECT R-1 TO DECLARE THE RESULT OF THE PETITIONER PERTAINING TO THE EXAMINATION 4TH SEMESTER OF B.COM DEGREE, HELD DURING APRIL / MAY 2015 AS THE WITHHOLDING OF THE RESULT IS ARBITRARY, UNJUST, ILLEGAL, IRRATIONAL, UNCONSTITUTIONAL AND VIOLATIVE OF ARTICLES 14, 16, 19 AND 21 OF THE CONSTITUTION OF INDIA.
THIS WRIT PETITION COMING ON FOR PRELIMINARY HEARING THIS DAY, THE COURT MADE THE FOLLOWING:
O R D E R Mr. M. Keshava Reddy, the learned counsel is directed to take notice for the first respondent-Bangalore University. Notice to second respondent is dispensed with.
2. The prayer made by the petitioner is for a direction to the respondent to announce results of fourth semester B.Com examinations conducted during April/May 2015. While seeking the said relief, the reasons for not announcing the results is not made available. Petitioner submits that though he made representation, the same has not been disposed of. The acknowledgement for having received the application has been produced as Annexure-C with the petition. From the acknowledgement produced, this Court cannot make out anything. Before seeking mandamus, the petitioner should make available the reasons for withholding the result and thereafter seek direction to the to the respondents.
3. Under these circumstances, in the ends of justice, the petitioner is permitted to make a representation with a specific prayer to the respondent; and thereafter, if the same is not considered by the respondent, liberty is reserved to him to approach this Court. Hence, the following:
O R D E R Petitioner is permitted to make a representation to the respondent University within a period of two weeks from today. On receipt of the representation/application from the petitioner, the respondent-Bangalore University is directed to consider and pass appropriate order within a period of two weeks thereafter.
Shri M. Keshava Reddy, the learned counsel to communicate this order to the first respondent.
