Heard learned counsel for the revisionists and the learned AGA for the State.
This revision has been preferred against the judgment and order dated 11.06.2018 passed by the Additional Sessions Judge/Special Judge (D.A.A.), budaun in S.S.T. No. 05/2002 (State vs. Pappu and others), arising out of Case Crime No. 281/2001, under Sections 396, 412 IPC, P.S. Bilsi, District Budaun, whereby the application under Section 91 Cr.P.C. moved by the revisionists has been rejected.
An application under Section 91 Cr.P.C. has been made seeking to summon the records of the electricity department to show that on the date of dacoity whether there was an electricity connection at the house of the complainant. The trial court has rejected the said application by means of the impugned order dated 01.06.2018 on the ground that the entire evidence is over and the case is now fixed for address of arguments. Summoning a document at this stage would put back the calender of trial.
In the opinion of the Court, there was no occasion for the revisionist to have waited for all this along when all the witnesses have been examined. He ought to have sought summoning of the record earlier. There is no infirmity in the order impugned. Accordingly, the revision fails and is dismissed.
