HON’BLE Dr. JUSTICE K.G.SHANKAR Criminal Petition No.6283 of 2014 Order:
The petitioners seek for quashment of First Information Report (FIR) in Crime No.133 of 2014 on the file of Chevella Police Station, Ranga Reddy District. They allegedly committed an offence under Section 3(1) (x) of the Scheduled Castes and the Scheduled Tribes (Prevention of Atrocities) Act, 1989 (the SCs/STs Act, for short). Petitioners 2 and 3 are the sons of the 1st petitioner. The 2nd respondent alleged that the petitioners committed the offence under the provisions of the SCs/STs Act.
2. The learned counsel for the petitioners submitted that the de facto complainant is an accused in a case where he allegedly molested the wife of the 1st petitioner herein. It is the case of the learned counsel for the petitioners that this case consequently is foisted. It is for the Police to investigate and reach the truth as the case is at the investigation stage. I therefore am not inclined to consider it appropriate to quash the FIR in Crime No.133 of 2014.
3. The 1st petitioner is said to be a teacher. Petitioners 2 and 3 are said to be students. In view of the calling of the 1st petitioner, I consider it appropriate to restrain the Police from arresting the 1st petitioner during the pendency of the investigation.
4. Consequently, this criminal petition is disposed of directing the Police to proceed with the investigation of the case in Crime No.133 of 2014 on the file of Chevella Police Station, Ranga Reddy District but not to arrest the 1st petitioner during the pendency of investigation.
The miscellaneous petitions, if any, pending in this petition shall stand closed.
