ORDER:
This Writ Petition is filed with the grievance that the respondents, without assessing the number of Eucalyptus trees over the petitioner’s land, are seeking to lay a 400 KV electrical line.
On behalf of the respondents, respondent No.2 filed a counter affidavit wherein it is stated that no tower is being laid over the petitioner’s land; that the land of the petitioner is in between tower No.24/3 and 25/0 and that as the conductor is being drawn over the petitioner’s land, the respondents will assess the number of trees and compensate for the loss, if any caused on account of damage to or removal of the Eucalyptus trees standing under the alignment of the electrical line.
In view of the stand taken by the respondents, which is placed on record, the Writ Petition is disposed of with the direction to respondent No.2 to properly assess the Eucalyptus trees, if any existing in the petitioner’s land under the alignment of the electrical line and pay compensation to her in the event of any damage being caused to them.
As a sequel to the disposal of the Writ Petition, interim order dated 27-10-2014 is vacated and WPMP No.40072 of 2014 and WVMP No.3411 of 2014 are disposed of as infructuous.
