The petitioner is aggrieved against the Advertisement dated 20.08.2017 issued in newspapers, calling for applications for appointment of LPG Distributors to so many places, out of which the petitioner is concerned with the areas viz., Pinnavasal, Palaiyur, Thirumakkotai and Sanganthi.
2. Heard the learned counsel for the petitioner and perused the materials placed before this Court.
3. The petitioner is admittedly a distributor under the respondent Indian Oil Corporation at Kottur area. According to the petitioner, the above said four areas are covered within the distribution area of the petitioner and therefore, the respondent Corporation shall not be permitted to invite applications for appointing of new distributors to the above said area, which in effect would affect the business of the petitioner. Admittedly, the distance between the petitioner area and other four areas are more than 10 kms, ranging from 12kms to 22 kms. Therefore, I do not think that the petitioner has any vested right to claim that they alone could do the business in the Kottur area, also by covering other four areas for which the impugned advertisement is given. This Court is of the firm view that the relief sought for in this writ petition is totally misconceived except with an intention to prevent another business competitor from locating the LPG distributorship. Therefore, I find no bona fide on the part of the petitioner in approaching this Court. Accordingly, this writ petition fails and the same is dismissed. No costs. Consequently, connected miscellaneous petitions are closed.
