Learned Senior counsel Mr. A. L. Shah appearing with Mr. Bomi H. Shethna for the petitioner submits that though they have tried their level best to serve respondent No.4, the notice of rule could not be served to him. In the proceedings before the Trial Court, the respondent No.4 was served by a public notice. Hence, in the present case also, he requests for the similar procedure to serve respondent No.4. The request is accepted. The respondent No.4 be served by a public notice to be published in a local daily newspaper having wide circulation in the city of Surat, within a period of 3 weeks from today. D.S. permitted.
