Heard learned counsel for the applicants and learned AGA for the State.
The present 482 Cr.P.C. application has been filed to quash the summoning order dated 6.7.2018 as well as entire proceedings of Case No. 789 of 2017, arising out of Case Crime No. 380 of 2017, under Sections 498A, 323, 504, 506 IPC and Section 3/4 D.P. Act, Police Station Rath, District Hamirpur.
Learned counsel for the applicants submits that the dispute between the parties arises out of the matrimonial dispute. From a perusal of the FIR the allegation appear to be wholly vague and general allegations against the applicants and they are living separately.
Matter requires consideration.
Notice on behalf of opposite party no. 1 has been accepted by learned A.G.A.
Issue notice to opposite party no.2 returnable at an early date.
Opposite parties may file their counter affidavits within six weeks. Rejoinder affidavit may be filed within two weeks thereafter.
List thereafter.
Till the next date of listing, further proceeding in the aforesaid case against the applicants shall remain stayed.
