JUDGMENT / ORDER

IN THE HIGH COURT OF KARNATAKA AT BENGALURU DATED THIS THE 29TH DAY OF AUGUST, 2019 BEFORE THE HON’BLE MR. JUSTICE K.N.PHANEENDRA CRIMINAL PETITION NO. 4822 OF 2019 BETWEEN:
MANJUNATH G AGED 39 YEARS S/O GANGAMARAPPA @ GANGAPPA R/A. DARGAJOGIHALLI HIGHTECH COLONY KASABA HOBLI, DODDABALLPURA TALUK BENGALURU RURAL DISTRICT.
... PETITIONER (BY SRI MAHESH S, ADVOCATE) AND THE STATE OF KARNATAKA BY DODDABALLAPURA RURAL POLICE STATION BENGALURU RURAL DISTRICT REPRESENTED BY STATE PUBLIC PROSECUTOR HIGH COURT BUILDING BANGALORE – 01.
... RESPONDENT (BY SRI K. P. YOGANNA, HCGP FOR RESPONDENT/STATE) THIS CRL.P IS FILED U/S.439 CR.P.C PRAYING TO ENLARGE THE PETITIONER ON BAIL IN CR. NO. 209/2018 OF DODDABALLAPURA RURAL POLICE STATION, BENGALURU CITY FOR THE OFFENCE P/U/S 302 OF IPC.
THIS CRIMINAL PETITION COMING ON FOR ORDERS, THIS DAY, THE COURT MADE THE FOLLOWING:
O R D E R At the time of submitting arguments, learned counsel for the petitioner fairly submitted that the evidence has already been commenced before the trial Court and PWs.1 to 4 have already been examined. Under the peculiar circumstances, if this Court considers the evidence on record, it virtually amounts to appreciation of evidence which is the exclusive domain of the trial Court. Therefore, under the above said circumstances, I do not find any strong reason to interfere at this stage. On the other hand, it is stated that the petitioner has been in custody since long time. Therefore, the trial Court has to make all its endeavour to dispose of the main matter as expeditiously as possible and within a span of six months from the date of receipt of copy of this order.
With the above observations, the petition stands dismissed.
