Hon'ble Anjani Kumar Mishra,J.
Mohammad Afzal, learned Advocate has appeared and states that he has instructions on behalf of the opposite party. He states that he has not been able to file his power despite his client having contacted him about five days back as he does not possess a digital signature. He is in the process of obtaining a digital signature.
From the tracking report available on record, it is clear that noitce of this transfer application was served upon the opposite party on 18.06.2018. Almost six weeks have elapsed, since.
Under the circumstances, the matter be listed in the next cause list, by which time, the power and counter affidavit on behalf of the opposite party must necessarily be availble on record, failing which, this Court may proceed with the matter on its merits, even in their absence.
Until further orders, further proceedings in Case No.72 of 2018 (Saurabh Arya Vs. Manju Shree), under Section 9 of the Hindu Marriage Act for retitution of conjugal rights, pending before the principal Judge, Family Court, Rampur shall remain stayed.
