JUDGMENT / ORDER

The petitioner has filed this writ petition challenging Ext.P4 proceedings of the second respondent under Section 406(3) of the Kerala Municipality Act, 1994 (the 'Act' for short). I notice that the petitioner has a statutory remedy by way of appeal provided by Section 509 of the said Act. The petitioner has admittedly not exhausted the said equally efficacious alternative remedy. In view of the above, I am not satisfied that this writ petition requires to be admitted. In view of the above this writ petition is dismissed, but without prejudice to the rights of the petitioner to challenge Ext.P4 by invoking the statutory remedy available to her. In order to facilitate the petitioner to invoke the statutory remedy it is ordered that Ext.P4 shall not be enforced for a period of two weeks from today.
