Heard learned counsel for the petitioner, learned Standing Counsel for respondent no. 1 and Sri Pawan Kumar Mishra, Advocate holding brief of Sri Pranjal Mehrotra, learned counsel for the respondent nos. 2 and 3.
The case of the petitioner is that her husband was working on the post of Coolie in Electricity Department and during course of service, he died on 15.9.2016. She has further stated that the Government Servant Dying in Harness Rules, 1974 provides that dependants of the deceased employee should be given appointment on compassionate ground. For the said purpose, she has filed a representation dated 3.1.2017 before the respondent no. 3 but the same has not been decided till date.
Lastly, learned counsel for the petitioner prayed that a suitable direction may be issued to respondent no. 3 to decide representation of the petitioner dated 3.1.2017 within time bound manner.
Sri Pawan Kumar Mishra, Advocate holding brief of Sri Pranjal Mehrotra, learned counsel for the respondent nos. 2 and 3 has no objection to the prayer made by the petitioner.
Considering the facts and circumstances of the case, with the consent of the parties, without adverting on the merits of the case, the petition is disposed of with a direction to respondent no. 3 to decide the representation of the petitioner dated 3.1.2017 within a period of two months from the date of production of certified copy of this order. Petitioner is given liberty to file a fresh representation alongwith certified copy of this order.
