By communication dated 14.03.2014, Joint Secretary- cum-Finance Controller, Vidhan Sabha Secretariate Uttar Pradesh conveyed the petitioner that she is not entitled for family pension being second wife of Late Sri Har Dayal Singh. Being aggrieved by the same, the petitioner preferred a petition for writ i.e., Writ Petition No. 1672 of 2016. The writ petition aforesaid is yet pending consideration before this Court. In the meanwhile, the petitioner submitted another representation and that too has been decided on 17.08.2017 with finding that being second wife, the petitioner is not entitled for family pension. Being aggrieved by the same the instant petition for writ is preferred.
We are of considered opinion that the cause of the petitioner is ultimately against the decision of the respondents for not awarding family pension to her being second wife and the same is under adjudication in Writ Petition No. 1672 of 2016. In view of it, there is no need to agitate same cause by filing a separate petition for writ.
The writ petition is dismissed.
The petitioner is at liberty to place a copy of the order dated 17.08.2017 on record of the writ petition that is already pending before this Court. The petitioner may also seek amendment in the writ petition, if required.
