Heard Sri Imran Ullah, learned counsel for the applicant and learned AGA for the State.
The present 482 Cr.P.C. petition has been filed for quashing the proceedings of Case No. 01 of 2018 (State vs. Ankita Jaiswal and another) in Case Crime No. 170 of 2017 u/ss. 307, 504, 506, 120B IPC, PS Kotwali, District Allahabad pending in the Court of learned Chief Judicial Magistrate, Allahabad in pursuance of chargesheet No. A-80/17.
It has been argued by the learned counsel for the applicant that though she is named in the FIR along with co-accused Ankita Jaislwal who happens to be the daughter of opposite party no.2 and there was some dispute between the mother and the said co- accused and the injured is the son of opposite party no.2 who has received gun shot injuries on his person. It is further submitted that co-accused Ankita had approached this Court and filed this application in which co-ordiante Bench of this Court passed the order dated 05.07.2018 directing her to seek discharge through counsel and so far as the applicant is concerned, she accompanied the co-accused Ankita prior to the incident in question when she went to threaten the mother and her son.
Considering the facts and circumstances of the case, I do not find any good ground for quashing the proceedings. The prayer to that effect is refused.
However, the applicant is directed to surrender before the Court concerned and apply for bail within a period of four weeks from today.
For a period of four weeks, no coercive action shall be taken against the applicant.
The present application is disposed of accordingly.
