There was an earlier order dated 2.11.2016 by which the Probate Case No.50/70 was required to be decided within a period of one year. This probate case was numbered as Original Suit No.8 of 2016 and thereafter the order-sheet reveals that the evidence was led by the parties and the matter is now to be finally decided. Eversince 26.11.2018 the order-sheet reveals that the matter has remained pending for final disposal/hearing.
Under such circumstances, once again a direction is being issued that the suit may now proceed on a day to day basis and be concluded within a period of three months from the date of presentation of a certified copy of this order. Adjournment, if any, may be granted only under very pressing circumstances and that too after imposition of a minimum cost of Rs.2000/- on the person seeking adjournment.
The writ petition is, accordingly, disposed of.
