Archana Kumari, learned counsel appearing on behalf of the petitioner submits that the petitioner has filed a Suit No.478/2015, (Smt. Manju Devi Vs.Pragyawati Devi & Ors), which is pending before Civil Judge (Junior Division), Bhadohi-Gyanpur for permanent injunction.
Learned counsel further submits that the defendants are delaying the adjudication of the aforesaid suit on one pretext or the other. The issues have been framed on 02.2.2018 and one of the issue has been decided on 22.3.2018 and thereafter the matter is not heard on the issue in accordance with the order dated 22.3.2018. She further submits that the plaintiff who is a lady her rights has been prejudiced due to delay in the disposal of the case.
Considered the submissions made at bar and perused the record.
This writ petition stands disposed of with the direction upon the learned court concerned to decide the Suit No.478/2015, (Smt. Manju Devi Vs.Pragyawati Devi & Ors), expeditiously in the light of the judgment passed by the Hon'ble Supreme Court in the matter of M/s. Shiv Cotex Versus Tirgun Auto Plast P. Ltd and others 2011 (89) ALR, 232, without granting any unnecessary adjournment to either of the parties.
