Heard learned counsel for the petitioner, Sri M.N. Singh who appears for the Commission and the learned Standing Counsel.
This petition has been preferred seeking the following principal reliefs:-
''Issue a writ order or direction in the nature of mandamus directing the respondent no. 2 to produce the answer key of the Staff Nurse (Female) Examination 2017 and a copy of petitioner's answer sheet.
Issue a writ, order or direction in the nature of mandamus directing the respondent no. 2 to include petitioners name in the list of selected candidates for the post of Staff Nurse (Female)."
However, as per the petitioner's own showing the testimonials were dispatched under registered cover on 14 March 2018 and were received by the Commission after the last date fixed which was admittedly 16 March 2018.
Bearing in mind the principle enunciated by the Full Bench of the Court in Rajendra Patel Vs. State of U.P. Writ-A No. 7401 of 2015, this Court is of the considered view that no relief as sought can be granted to the petitioner. In fact the reliefs as framed do no even arise for consideration.
Accordingly and for the reasons aforenoted, this petition is dismissed.
