(Per : HONOURABLE MR.JUSTICE RAVI R.TRIPATHI) The present application is filed by the convict through his wife Sonu Manjitsing Anand praying for temporary bail for a period of 60 days for the purpose of making arrangement of residential accommodation and also to make arrangement for livelihood.
In support of the application, photograph is produced showing that the house which is claimed to be residence of the present applicant is without any roof. Xerox copy of the photograph produced did not convey any meaningful information. On inquiry, the applicant has produced the original photograph. It does not appear to be a residential accommodation by any standard.
The applicant states that she was residing in this premises with her parents and the parents have expired. She further states that her in-laws have agreed to pay the expenses of the education of the child (girl child) who is admitted in a school at Rajasthan.
On perusal of papers, it is noticed that earlier Criminal Misc. Application No.6847 of 2012 was filed wherein this Court passed order dated 17.5.2012 grating temporary bail for a period of 10 days so as to enable him to arrange for the education of the child.
The address mentioned in the application of the applicant (wife of the convict) was that of Old Vadaj, Sorabji Compound, B/h.Laxmi Bakery, Sardarjika Tekra, 'Ahmedabad'. Nowhere it is mentioned in the application that the applicant is going to get her daughter admitted in Rajasthan.
On further inquiry, the applicant states that as in laws have agreed to provide the expenses for the education of the girl child, they have got her admitted in Rajasthan.
On perusal of the papers, the Court is not convinced of the ground for which the temporary bail is sought for.
Hence, this application is rejected.
