Admittedly, the order impugned is appeallable but the contention of the learned counsel for the petitioner on the strength of averments made in the writ petition is that court of Commissioner is vacant as the Commissioner is busy in parliamentary election.
Learned A.G.A. has informed the Court that parliamentary election in Bulandshahar is over. If that be so, petitioner may file statutory appeal before the court concerned within a month from today, which shall be heard and decided on merits without raising plea of limitation.
With the aforesaid observations, present petition is disposed of.
