(BY SRI.CHETAN DESAI, HCGP.,) ... PETITIONER ... RESPONDENT THIS PETITION IS FILED UNDER SECTION 439 OF CR.P.C. PRAYING TO ENLARGE THE PETITIONER ON BAIL IN CR.NO.25/2016 (C.C. NO.1680/2016) OF HASSAN EXTENSION P.S., HASSAN DISTRICT FOR THE OFFENCE PUNISHABLE UNDER SECTIONS 399, 402 OF IPC.
THIS PETITION COMING ON FOR ORDERS THIS DAY, THE COURT MADE THE FOLLOWING:
ORDER Heard the learned counsel for the petitioner and the learned High Court Government Pleader for the respondent-State.
2. The petitioner along with co-accused is charge sheeted by the respondent-police in respect of the offences punishable under Sections 399 and 402 of IPC.
3. The allegation is, accused Nos.1 to 5 were waiting to rob the public on the road, they were armed with legal weapons and were apprehended by the Investigating Officer. Investigation is complete and no criminal antecedent is shown to the credit of this petitioner. In the given circumstance, there is no impediment to allow the petition.
4. Accordingly, petition is allowed. Petitioner is enlarged on bail in Crime No.25/2016 registered by the respondent-police, subject to the following conditions:-
i) He shall execute a self bond for a sum of Rs.50,000/- (Rupees fifty thousand only) with one surety for the like sum to the satisfaction of the concerned Court.
ii) He shall mark his attendance before the respondent-Investigating Officer on every alternate Tuesday during the office hours till conclusion of trial.
