THE STATE OF KARNATAKA, REPD.BY RAMANAGAR RURAL POLICE STATION, RAMANAGAR.
REPTD. BY ITS S.P.P., HIGH COURT BUILDING, BANGALORE-560 001 ...RESPONDENT (BY SRI S.VISHWA MURTHY, HCGP) THIS CRIMINAL PETITION IS FILED UNDER SECTION 438 OF CR.P.C PRAYING TO ENLARGE THE PETITIONER ON BAIL IN THE EVENT OF HIS ARREST IN CRIME NO.291/2016 OF RAMANAGARA RURAL POLICE STATION, RAMANAGARA DISTRICT FOR THE OFFENCE P/U/S 406, 419, 420, 468, 471, 506 R/W 34 OF IPC.
THIS PETITION COMING ON FOR ORDERS THIS DAY, THE COURT MADE THE FOLLOWING:
O R D E R This petition is filed under Section 438 of Cr.P.C seeking anticipatory bail in Crime No.291/2016 registered by Ramanagara Rural Police Station, for offences punishable under Sections 406, 419, 420, 468, 471 and 506 read with Section 34 of IPC.
2. The learned counsel for the petitioner submits that the allegation against the petitioner is that he has cheated an aspirant youth by offering them jobs in Bangalore Metro by demanding Rs.2,00,000/-. The matter is under investigation. Accordingly, he prays that if an opportunity is given, he shall surrender before the police and co- operate with the investigation.
3. The petition is strongly opposed by the learned High Court Government Pleader on the ground that the petitioner and his team members have collected more than Rs.64,00,000/-. In the circumstances, it would be unsafe to release the petitioner on anticipatory bail.
4. I have carefully considered the submissions of the learned counsel for the parties and perused the material papers.
5. The complaint averments, in my view, do not entitle the petitioner an order of anticipatory bail. At this stage, the learned counsel for the petitioner submits that he shall surrender before the police or jurisdictional Magistrate and seek regular bail. Recording the said submission, this petition is dismissed.
