JUDGMENT / ORDER

The petitioner, who was the surety to a loan availed by the 3rd respondent from the 1st respondent, was proceeded against for satisfaction of the loan amounts. The 3rd respondent, who was the original borrower had committed default in which event, the petitioner was proceeded against. 2. The learned counsel appearing for the 1st respondent would submit, on instructions, that, the entire amounts due have been recovered from the salary of the petitioner. In such circumstances, nothing survives in the above writ petition.
3. However, the petitioner would be entitled to proceed against the 3rd respondent WP(C).36274/08 2 for recovery of the amounts which the petitioner has satisfied to the loan availed by the 3rd respondent.
The writ petition is closed, with the above observation.
