JUDGMENT / ORDER

1. Admit.
Mr.Ashish Dagli, learned advocate waives service of notice of admission on behalf of the respondent.
2. Following substantial questions of law arise for determination in the present second appeal:
(i) Whether learned Appellate Court is justified in holding that the wife has deserted the appellant-husband without reasonable cause?
(ii) Whether in the facts and circumstances of the case, learned Appellate Court has properly appreciated the documentary evidence, which are produced at Exhs.61 to 65 and consequently allowed the appeal?
(iii) Whether learned Appellate Court has framed proper Points for determination under Order 41 Rule 31 of the Code of Civil Procedure?
3. Considering the fact that the dispute is matrimonial dispute, it will be open for the appellant to submit an appropriate application for fixing early date of hearing of appeal, after submitting paper-book.
4. Print is dispensed with. Registry is directed to call for record and proceedings of the case from the learned Trial Court immediately.
