JUDGMENT / ORDER

Petitioner is accused in Crime No.616 of 2014 of the Varkala Police Station for the offence punishable under Sec.306 of the Indian Penal Code, is in custody from 24.05.2014 and seeks bail.
2. Learned Public Prosecutor has opposed the application.
It is submitted that a relative of the de facto complainant committed suicide on 05.06.2014 and investigation indicated that the deceased had availed a loan of `4,00,000/- from the de facto complainant and in spite of repaying `13,00,000/-, he was still harassed demanding more money and the deceased committed suicide. A suicide note indicating involvement of the petitioner was seized from the deceased.
3. Learned counsel submits that the allegations are not true and that no incriminating article was seized from the petitioner so far. The suicide note is also not clear that the petitioner is the person involved. It is further argued that the petitioner is a heart patient.
4. Since the investigation is not completed, I am inclined to think that request for bail cannot be allowed as grant of bail would B.A.No.4490 of 2014 2 affect further investigation.
The application is dismissed without prejudice to the petitioner moving again after the investigation has progressed.
