The petitioner by way of this petition prays for issuance of a writ in the nature of mandamus directing the respondent no.2 to give employment to the petitioner on compassionate grounds.
Vide impugned order, the representation of the petitioner has been dismissed while saying that the petitioner is not eligible for appointment as Conductor or Driver. Sofar as Class IV post is concerned, staff is already surplus in the U.P. Road Transport Corporation, Devi Patan Mandal, District Bahraich, and, therefore, offer of employment cannot be given.
Let affidavit be filed on behalf of respondent concerned in regard to the fact that staff if already surplus and, therefore, employment cannot be given to petitioner on compassionate grounds.
