This petition has been filed by the seven retired employees who have superannuated from the post of Gram Panchayat Adhikari on different dates between 2010 to 2012. They have approached this Court with the grievance that though the office of District Panchayat Raj Officer correctly fixed their salary on 31.7.2012 but the office of Additional Director Pension and Treasury unilaterally reduced the salary of the petitioner and consequential pension.
In order to elaborate such grievance, attention of the Court has been invited to the order of the District Panchayat Raj Officer, Allahabad, dated 31.7.2012, in respect of petitioner no. 1 wherein his salary has been fixed at Rs.23560/- but the Additional director Treasury and Pension has treated the salary to be Rs. 22,870/-. It is stated that no reason has been assigned for reduction of salary and various representations made in that regard have also not been examined by the authority concerned, hence this writ petition.
Learned Standing Counsel submits that in case petitioners raises their grievance, the same shall be considered by the authority concerned, in accordance with law, by a reasoned order.
In the facts and circumstances, noticed above, writ petition stands disposed of by permitting the petitioners to represent their grievance before respondent no. 3, annexing all materials in support of their claim, alongwith certified copy of this order within a period of three weeks from today. The authority concerned shall examine the petitioners' entitlement in accordance with law and applicable Government Orders, by passing a reasoned order, within a period of three months thereafter. All consequential action shall be taken accordingly.
