On the matter being taken up, learned A.G.A. submits that he has not received instructions in the present case.
Accordingly, put up this case as a fresh case on 27.4.2021 before appropriate Bench.
Learned A.G.A. shall ensure that instruction are received by her before 27.4.2021, failing which, Court shall be constrained to summon the concerned S.P/S.S.P as well as the Investigating Officer on the next date fixed after 27.4.2021.
As the matter has been adjourned only on account of fact that learned A.G.A. has not received instruction, it is necessary that interest of applicant be also protected. Accordingly, it is provided that the applicant shall not be arrested in Case Crime No. 084 of 2021 under sections 498A, 323, 376,377, 354, 506 I.P.C and 3/4 D.P. Act, P.S. Cantt, District Gorakhpur, till 27.4.2021.
Copy of the order be supplied to learned A.G.A. forthwith.
