Heard learned counsel for the petitioners; learned A.G.A. for respondents 1, 2 and 3; and perused the record.
The instant petition seeks quashing of the First Information Report dated 8.9.2018 registered as Case Crime No. 603 of 2018, under Sections 323, 504, 506, 452, 325 & 307 I.P.C., at Police Station - Kasia, District - Kushinagar.
A perusal of the First Information Report reveals that informant's husband and other family members were assaulted by the accused persons including the petitioners. Informant's husband received grievous injuries and, therefore, no case for quashing of the First Information Report is made out.
The learned counsel for the petitioners has sought to argue that the petitioner no. 1 is a student and is a minor therefore some protection may be given to the petitioner no. 1.
If the petitioner is minor he may claim juvenility before the appropriate forum or court as per law but it cannot be a ground to quash the First Information Report.
