Criminal Original Petitions filed under Section 482 Cr.P.C. to modify the condition of the learned Principal sessions Judge, Salem, made in Crl.M.P.Nos.203 and 208 of 2017 respectively dated 20.1.2017 “the petitioner shall stay at Trichy and report and sign before the learned Judicial Magistrate No.I, Trichy daily twice at 10.00 a.m. and 5.00 p.m. until further orders”.

For Respondent : Mr.C.Emalias, Addl. Public Prosecutor COMMON ORDER The present criminal original petitions have been filed to modify the condition imposed by the learned Principal sessions Judge, Salem, in Crl.M.P.Nos.203 and 208 of 2017 respectively dated 20.1.2017.
2. It is the case of the petitioners that they have been arrayed as accused in Crime Nos.551 and 552 of 2016 on the file of the respondent police and they were granted bail by the learned Principal sessions Judge, Salem, in Crl.M.P.Nos.203 and 208 of 2017 respectively dated 20.1.2017 on certain conditions. One of the conditions is that they shall stay at Trichy and report and sign before the learned Judicial Magistrate No.I, Trichy daily twice at 10.00 a.m. and 5.00 p.m. until further orders”. Since the petitioners are farmers, they are unable to comply with the said condition. Hence, seeking modification of the said condition, the petitioners have come up with the present petitions.
3. Learned Additional Public Prosecutor has no objection to modify the said condition.
4. In view of the same, the condition imposed on the petitioners in Crl.M.P.Nos.203 and 208 of 2017 respectively dated 20.1.2017 by the learned Principal sessions Judge, Salem, viz., “the petitioners shall stay at Trichy and report and sign before the learned Judicial Magistrate No.I, Trichy daily twice at 10.00 a.m. and 5.00 p.m. until further orders” is hereby modified as follows:-
“ The petitioners shall appear before the learned Judicial Magistrate No.II, Sankagiri, on the first working day of every week at 10.30 a.m., for a period of two months.”
The other conditions shall remain unaltered. Both the Criminal Original Petitions are ordered accordingly.
