Heard learned counsel for the applicant and learned A.G.A. for the State and perused the material placed on record.
Learned counsel for the applicant has submitted that in Criminal Misc. Application No.27955 of 2011 under Section 482 Cr.P.C., the Court has referred the matter to Mediation and Conciliation Centre as the dispute between the parties was matrimonial one.
Learned counsel states that Mediation Centre has submitted report that the same was successful and has also filed settlement agreement dated 10.02.2012 in which the present case is mentioned at 6(d)(vii). The only prayer of the applicant is that the case under Section 406 I.P.C. pending before 4th Additional Chief Judicial Magistrate, Ghaziabad may be directed to be decided within a stipulated period.
Be that as it may, without expressing any opinion on the merits of the applicant's case, this application U/s 482 Cr.P.C. is finally disposed of with a direction to the courts below to decide the Case No. 410 of 2017(Durgesh Sharma alias Radhika vs. Manish Sharma and others) under Section 406 I.P.C., Police Station Kotwali,District Ghaziabad in accordance with law without granting unnecessary adjournments to either of the parties as expeditiously as possible preferably within a period of three months from the date of production of a certified copy of this order, if there is no legal impediment.
