Heard learned counsel for the petitioner; learned A.G.A. for the respondents 1, 2 and 3; and perused the record.
The instant petition seeks quashing of the first information report dated 24.01.2019 registered as Case Crime No.49 of 2019, under Sections 147, 148, 149, 302, 201 IPC, P.S.
Shahpur, District Gorakhpur.
The impugned first information report relates to an offence of murder naming few and also disclosing participation of few unknown.
The prayer to quash the first information report has been made on the ground that the name of the petitioner has surfaced in the confessional statement.
Once the complicity has been discovered investigation would have to be brought to its logical conclusion. Hence, the prayer of the petitioner to quash the first information report on the above ground cannot be accepted. The petition is dismissed.
