Heard learned counsel for the petitioner and learned A.G.A. for the State through Video Conferencing.
By means of this writ petition, the petitioner has prayed for a writ of mandamus commanding the opposite parties to consider the prayer for providing adequate security to the petitioner who is a prospective candidate for election as Gram Pradhan.
It is submitted that in the previous election for the same very office when the petitioner's mother was a prospective candidate, his father during the course of election campaign was subjected to a brutal murder and a case in relation thereof i.e. case crime no. 612 of 2015 under Sections 147, 148, 149, 352, 307 and 302 I.P.C. is already pending. It is also submitted that the same very party is also the candidate in the present election on the opposition, as such, the petitioner is faced with the threat to his life. It is for this reason that the petitioner has approached the opposite party nos. 3 and 4 for being provided necessary security through a representation as contained in annexure-2.
On a plain reading of the application as contained annexure 2 to the writ petition, it is evident that the petitioner has made a reference to the relevant facts germane for consideration of his prayer relating to the security to his life has been prayed for. It is expected that the police authorities i.e. opposite party nos. 3 and 4 shall consider the prayer of the petitioner for being provided necessary security on payment of the necessary charges as per the standing orders of the government in this regard.
The prayer made by the petitioner in the representation dated 4.4.2021 shall be considered promptly and preferably within a period of three days from the date a copy of this order duly attested by the counsel is presented before the authorities concerned.
The consideration of the petitioner's request in any case may be attended without any delay by the competent authority as the election is scheduled on 19.4.2021.
The writ petition is accordingly disposed of.
